Welcome to Khadija Art and Craft. These Terms of Service  govern your access to and use of our website and any purchases made through it. By browsing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

1. Account Terms

  • You do not need an account to browse our website, but you may need to create one to place an order or track your purchases.
  • You must provide accurate, current, and complete information when creating an account or placing an order.
  • You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account.
  • You must be at least 18 years old, or have the permission of a parent/guardian, to make a purchase on our website.
  • We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent activity.

2. Pricing and Payment

  • All prices listed on our website are in Pakistani Rupees (PKR) unless stated otherwise, and are subject to change without prior notice.
  • We make every effort to display accurate pricing; however, in the event of a pricing error, we reserve the right to cancel or correct the order and will notify you before proceeding.
  • Payment must be made in full at the time of order, through the payment methods available at checkout (e.g., Cash on Delivery, bank transfer, or online payment via [PAYMENT PROVIDER NAME]).
  • For Cash on Delivery orders, payment is due in full to the courier upon delivery.
  • Any applicable delivery charges, taxes, or fees will be clearly stated at checkout before you confirm your order.

3. Product Descriptions

  • We strive to display our products, including images, colours, and descriptions, as accurately as possible. However, slight variations may occur due to the handmade nature of our products, screen display settings, or manufacturing differences.
  • Since many of our items are handcrafted, minor differences in size, shape, or finish compared to the product photos should be expected and are not considered defects.
  • We reserve the right to limit quantities, discontinue products, or update product descriptions and pricing at any time without prior notice.

4. Order Acceptance

  • Placing an order on our website constitutes an offer to purchase. All orders are subject to acceptance and availability.
  • We reserve the right to refuse or cancel any order for reasons including, but not limited to: product unavailability, errors in pricing or product information, suspected fraudulent activity, or issues with payment.
  • If we cancel an order after payment has been made, you will receive a full refund within 30 business days.
  • You will receive an order confirmation via email or SMS once your order has been successfully placed. This confirms we have received your order, not that it has been accepted or dispatched.

5. Shipping and Delivery

  • We currently ship to locations across Pakistan. Delivery timelines vary depending on your location and are typically estimated at checkout.
  • Orders are usually processed and dispatched within 03 business days, followed by delivery through our courier partners.
  • Free delivery may apply to orders above a specified amount, as indicated on our website at checkout.
  • We are not responsible for delays caused by courier services, incorrect address information provided by the customer, or circumstances beyond our reasonable control (e.g., weather, strikes, natural disasters).
  • Risk of loss and title for items purchased pass to you upon delivery to the shipping address provided.

6. Returns and Refunds

  • We accept returns on unopened and unused products within 03 days of delivery, unless otherwise stated on the product page.
  • To initiate a return, please contact us at khadijaartandcraft9@gmail.com with your order number and reason for return.
  • Products must be returned in their original packaging, with all included items (paints, brushes, figures) intact.
  • Due to hygiene and safety reasons, opened paint sets or used products may not be eligible for return unless defective or damaged upon arrival.
  • Once your return is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed within 07 business days, to the original payment method or as store credit, at our discretion.
  • If you receive a damaged, defective, or incorrect item, please contact us within 03 days of delivery with photos of the issue, and we will arrange a replacement or refund at no additional cost.
  • Shipping charges (if applicable) are non-refundable, and return shipping costs are the customer's responsibility unless the return is due to our error.

7. Prohibited Uses

You agree not to use our website for any purpose that is unlawful or prohibited by these Terms. This includes, but is not limited to:

  • Using our website to transmit any harmful, offensive, or fraudulent content
  • Attempting to gain unauthorized access to our systems, accounts, or data
  • Using automated tools (bots, scrapers) to access or extract data from our website without permission
  • Interfering with the proper functioning of our website or placing fraudulent orders
  • Reproducing, duplicating, copying, or reselling any part of our website or products without our express written permission
  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity

We reserve the right to terminate access to our website for any user who violates these terms.

8. Intellectual Property

All content on our website including but not limited to product designs, images, logos, text, and graphics is the property of Khadija Art and Craft and is protected by applicable copyright and trademark laws. You may not use, reproduce, or distribute any content from our website without our prior written consent.

9. Limitation of Liability

  • To the fullest extent permitted by law, Khadija Art and Craft shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products, including but not limited to loss of data, loss of profits, or personal injury resulting from misuse of our products.
  • Our products are intended for use under adult supervision where indicated. We are not responsible for injury or damage resulting from improper use, including ingestion of non-food items or misuse of painting materials.
  • Our total liability for any claim arising from your purchase shall not exceed the amount paid for the product in question.
  • Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Pakistani law.

10. Indemnification

You agree to indemnify and hold Khadija Art and Craft, its owners, employees, and partners harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of our website or products.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our website after any changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
